日本だと成立しない。廃墟写真の判例がある。写真の著作権は非常に弱くて、現像したものにしかなりたたない。NEFとかのRAWデータは著作物ではない。
私の個人的感覚からすると、被写体の選択、構図とか、撮影条件に著作性があると思うので？なのですが。もっともパロディ写真のようなものはどうするのかとか難しい話が出てくることもあるでしょう
